The following deviating provisions apply: 

– Article 4 – Dissolution does not apply in any case and does not apply;
– Article 8 – paragraph 5: Payment is made prior to the rental period;
– Article 9 – paragraph 6: Rental items may not leave the province or go to Amsterdam;
– Article 14 – paragraphs 3 & 6: It is not permitted to carry out any repairs to the rented property without the landlord's permission;

The following deviating provisions apply to the rental of an (E-) scooter/moped and Speed-pedelec: 

• Article 4 – Termination shall in no event apply and shall not apply;
• Article 8 – paragraph 5: Payment must be made prior to the rental period;
• Article 9 – paragraph 2: It is not permitted to make any changes to the E-scooter/Speed-Pedelec or to the rental item.
• Article 9 – paragraph 4: Rental items may only be used in our region and not in the dune area.

Summary of the most important BOVAG conditions/additional conditions

Theft responsible for the current value of the bicycle and in the case of taken out insurance only for your own risk (conditions proper handling of the bicycle, handing over keys and reporting to the police). Own risk is max. € 150 per bicycle, € 300 per electric bicycle and € 500 per E-scooter / Speed-Pedelec, provided that the rental conditions have been observed (12.1).

If you do not want a deductible, you can take out the 'Cycling in Egmond Certainties' package

• The tenant is liable for the rented property (in the case of groups, the main tenant);
• Early return of the rental item does not entitle you to a refund;
• The rented property may not leave the province or go to Amsterdam;
• Payment is made prior to the rental period;
• The lessor reserves the right to confiscate the bicycle without the right to a refund of the rental fee if these rental conditions are not complied with;
• The rental item must be returned to the branch where it was rented;
• The landlord reserves the right to charge a deposit;
• The renter is obliged to take good care of the bicycle/e-scooter/speed pedelec:
  • The bicycle/e-scooter/speed pedelec must be locked
  • The renter must handle the keys of the bicycle/e-scooter/speed pedelec with care.
  • The battery must be charged according to the relevant instructions;
  • The renter must secure luggage correctly;
  • The renter must ensure that the bicycle/e-scooter/speed pedelec is not used by anyone who is not capable or authorized to do so;
  • E-scooters/mopeds can only be rented and driven by persons over the age of 16 and:
  • The driver must show his moped or car/motorcycle license to the rental company;
  • The rental company will record the driver's license number with the rental number, which may only be driven by the authorized driver;
  • The driver must comply with the legally applicable traffic regulations and the applicable Fietsen in Egmond motorized two-wheeler rental conditions;
  • The rental property may not be used outside the designated roads/paths. 
    (The bicycle/e-scooter/speed pedelec is therefore NOT allowed on the beach); - It is not permitted to make any changes to the bicycle/e-scooter/speed pedelec or to the rental item;
  • It is not permitted to attach your own bicycle trailer to the rented bicycle or, conversely, to attach a rented bicycle trailer to your own bicycle;
  • It is prohibited to take persons on the back of a luggage rack (except in child seats rented from the lessor);
  • The tenant is obliged to report any damage and/or loss to the landlord as soon as possible;
  • It is not permitted to carry out any repairs to the rented property without the landlord's permission.

If an agreement is cancelled by the tenant, the landlord may charge the following cancellation fees:

• In case of cancellation up to the 30th day (exclusive) before the day of rental: the deposit with a maximum of 10% of the rental amount;
• In case of cancellation from the 30th day (inclusive) up to the 7th day (exclusive) before the day of rental: 30% of the rental amount;
• In case of cancellation from the 7th day (inclusive) to the 3rd day (exclusive) before the day of rental: 50% of the rental amount;
• In case of cancellation from the 3rd day (inclusive) up to 1 day (exclusive) before the day of rental: 90% of the rental sum;
• In case of cancellation less than 1 day before the day of rental: the full rental amount

TERMS AND CONDITIONS 'CYCLING IN EGMOND GUARANTEES' – PACKAGE

Tenant can take out the 'Cycling in Egmond Guarantees' package with the landlord per rented object, the costs for this are 10% of the total rental price, excluding any deposit. If tenant has taken out the 'Cycling in Egmond Guarantees' package with landlord, tenant is for the object in question:

• No costs are due in the event of cancellation in the event of death of relatives of the tenant or of persons for whom the rental property was rented;
• In addition to and in deviation from the cancellation cost scale from the BOVAG/SER rental conditions, no cancellation cost compensation is due - regardless of the 'timing' - in the event of cancellation in the event of the death of relatives of the tenant or of persons for whom the rental property was rented;
• No cancellation fees will be charged (at least 48 hours in advance) if the person for whom the property was rented has become ill prior to the rental period and will not be using the rented property due to this illness;
• In addition to and in deviation from the cancellation fee scale from the BOVAG/SER rental conditions, no cancellation fee is due in the event of cancellation at least 48 hours in advance if the person for whom the object was rented is ill prior to the rental period and will not use the rented object due to this illness.
• The deductible will never be charged in the event of damage to the rental property, unless the damage is caused by damage or loss (also known as theft or loss) outside the province or in Amsterdam.
• In view of the BOVAG/SER rental conditions, the consumer is generally liable for damage to the entrepreneur per claim up to the deductible stated on the rental agreement. However, due to our 'Fietsen in Egmond Zekerheden' – Package, the following applies:
  • The deductible will never be charged in the event of damage to the rented property consisting of loss, if the tenant can show the key to the rented property and reports the loss in Egmond (whether it was theft or loss) to the police and a copy of the report is submitted to the landlord.
  • The rented item may not leave the province or go to Amsterdam in accordance with the Fietsen in Egmond General rental conditions. Missing items that occurred outside this region or in Amsterdam are therefore not covered by the Fietsen in Egmond guarantees.  

All disputes arising from the lease agreements shall be governed exclusively by Dutch law. Furthermore, only the Dutch courts shall have jurisdiction to hear these disputes.
